Hague: The last Option

We all saw it;Church Fires,Police killing innocent civilian and all the madness that was post poll violence.

All this that we saw cannot be be kicked under the bed and be assumed as if nothing ever overflowed.

And now we are divided in the way in which this thorny issue should be addressed,yet we have a better conscience to know better that what meats the eye in the case of the Waki report implementation.

I still stand against the Hague route and hold my grounds that a local tribunal is the best answer here,this will make the victims participate in the process and in return give Kenya a better platform to heal and reform its systems.

But this can only be achieved if....

We ensure the Tribunal is protected in the Constitution, Eliminate Immunity ‘of any mentioned’ that the leading elite want to use in their support,disassociate the EXECUTIVE from any involvement in the formation of the tribunal in the form of Judges’ appointment and so forth, the Executive should also be restrained from having any legal powers to terminate the Term of the tribunal due to any need that might arise,the Attorney general’s (he is the governments Mr.Fix it) prosecution powers should not be subjective to the tribunal and above all this tribunal should be carried under close supervision by local and international players involved it is only through this that we can de-link our morally defunct Judicial system that has been the scare of justice from the quest for justice through a local Tribunal

The Hague is a route that would take Kenya to another failed route only known to the world of Utopia.

Truly,this should our starting point,but eventually if they don’t come up with an incorruptible tribunal what remains next?

Duncan,Many people will not see the sense behind your struggles,unfortunately some of them are here with us i have always believe that Kenya has always been ran without reason,that is why many will fight reason.

And yes,the Hague is only a last option.

Duncan,people think that Kenya has already healed,they forget that any time the violence can erupt again if this issue of the Waki report is not handled carefully.

Duncan,even former president Moi was better,he made decisions,and stood by them,but the major problem in Kenya now is reflected in your article ’Oh my Kenya’ our leaders of today think that the common ’mwananchi’ has no say in the running of government,that is why many of them would want to hijack a lawful process so as to escape the net.
I support your cal for a local Tribunal basing on the reasons that you have brought forward and argued for.

Seems as if your judicial system is very similar to ours; corrupt, inept, and defunct.

but it can be rehabilitated..In Mexico, our President is holding ”Operation Clean Up” clearing out corrupt ”MR. FIXERS”...We are also slowing incorporating more and more open court sessions, as opposed to JUDGE only inquistional law..
